Website terms and conditions of use

The Spanish version of these Terms is the legally binding text. This translation is provided for reference only.

1. Website owner and acceptance

The website greyfieldstrata.com (the “Site”) is operated by Greyfield Strata (the “Company”). Its full identification and contact details are set out in the Personal Data Processing Policy.

By accessing or using the Site, you accept these Terms and Conditions of Use. If you do not agree with them, please do not use the Site.

These Terms are supplemented by the Personal Data Processing Policy and the Cookies and Local Storage Policy, which form an integral part of them.

2. Purpose of the Site

The Site is informational: it presents the Company, its products and services, publishes content of interest and allows those interested to contact us or join waitlists for products in preparation.

We strive to keep the information published accurate, clear and up to date. The final features, prices, timelines and other conditions of any product or service will be set out in the quote, proposal or service order signed with each client, in accordance with Law 1480 of 2011 (Colombian Consumer Statute) where applicable.

Sending a message or joining a waitlist through the Site does not in itself create a contractual relationship with the Company or oblige it to provide any service.

3. Services and published agreements

The Company’s services are not governed by these Terms. Standardized services are contracted under the Master Services Agreement, the specific terms of each service and a service order, published in the Legal section of the Site. Consulting and custom projects are governed by the contract signed with each client.

Access to the Company’s client platforms, linked from the Site, is governed by the contract applicable to each client and not by these Terms.

4. Informational content

The articles, research notes, simulators, examples and other content on the Site are for informational purposes only. They do not constitute legal, financial, actuarial, investment or any other kind of advice, nor do they replace a professional’s analysis of a specific case. Numerical examples are illustrative and do not refer to real clients or portfolios unless expressly stated otherwise.

5. Intellectual property

The texts, trademarks, logos, trade names, images, illustrations, designs, source code and other content of the Site are owned by the Company or used with the authorization of their owners. They are protected by Colombian and Andean copyright and industrial property law, including Law 23 of 1982 and Decision 486 of 2000 of the Andean Community.

You may browse the Site, share links to its pages for personal or informational purposes and quote short excerpts citing the source. You may not reproduce, modify, distribute, publicly communicate or commercially exploit its content without the Company’s prior written authorization.

Nothing in these Terms grants a license to the Company’s trademarks or content.

6. Use of the Site

You agree to use the Site lawfully, in good faith and in accordance with these Terms. In particular, you may not:

• Attempt to gain unauthorized access to the Site’s systems, servers or data, or breach its security measures.
• Introduce viruses, malicious code or anything that may harm the Site or other users.
• Extract content in bulk or by automated means in order to reproduce it or exploit it commercially, or in a way that overloads the Site. Automated reading for search engine indexing and by artificial intelligence assistants is permitted, provided it follows the instructions in the Site’s robots.txt and llms.txt files.
• Submit false, offensive or unlawful content, unsolicited advertising, or third parties’ data without their authorization through the forms.
• Impersonate another person or entity.

Forms. By using the contact form or the waitlist form, you declare that the information provided is accurate and that you are the owner of the data or are authorized to share it. The processing of that data is governed by the Personal Data Processing Policy. To protect the forms against automated use, the Site uses a Cloudflare verification service, described in the Cookies and Local Storage Policy.

The Company may block or discard messages and access that breach these rules.

7. Third-party links

The Site may contain links to third-party sites or services. The Company does not control those sites and is not responsible for their content, availability or privacy policies. We recommend reviewing the terms and policies of every site you visit.

8. Availability and liability

The Company strives to keep the Site available continuously and free of errors, but cannot guarantee it. The Site may be temporarily suspended for maintenance, updates or causes beyond our control.

To the extent permitted by law, the Company will not be liable for damages arising from service interruptions, technical failures, misuse of the Site by third parties or decisions made solely on the basis of general information published on it. This limitation does not affect the rights the law grants to consumers that cannot be waived.

9. Personal data and cookies

Personal data you provide through the Site will be processed in accordance with Law 1581 of 2012, its implementing decrees and our Personal Data Processing Policy. The use of cookies and local storage, including analytics cookies that only run with your consent, is described in the Cookies and Local Storage Policy.

10. Changes

The Company may modify these Terms at any time. The current version will always be the one published on the Site, with its update date and version number. Changes take effect upon publication.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Bogotá D.C., Colombia, without prejudice to the rights the law grants consumers to turn to the Superintendence of Industry and Commerce or other authorities.
